Service Description
Texas Pest Control provides professional pest management and extermination services to residential and commercial properties throughout the State of Texas. Our services include, but are not limited to, general pest control treatments for insects, rodents, termites, and other common pests native to Texas; integrated pest management programs; preventative maintenance plans; wildlife exclusion; and emergency pest removal services. Specific treatment methods, products used, and service frequency will be determined based on property inspection, pest species identified, and the unique environmental conditions of each location. All services are performed by licensed technicians in accordance with Texas Department of Agriculture regulations and applicable federal guidelines. Service appointments require adult presence at the property unless prior written authorization is provided. Access to all areas requiring treatment, including crawl spaces, attics, and exterior perimeters, must be available at the scheduled service time. Weather conditions, pest biology, and property characteristics may affect treatment timing and effectiveness.
No Guarantee or Warranty
Texas Pest Control does not guarantee complete elimination of all pest activity from your property. Pest management is influenced by numerous factors outside our reasonable control, including neighboring property conditions, seasonal weather patterns, structural deficiencies, sanitation practices, and pest migration from surrounding areas. Results may vary based on these and other environmental factors. Any statements made by representatives regarding expected outcomes are estimates based on typical experiences and do not constitute warranties or guarantees of specific results. We do not warrant that treatments will prevent future infestations or that treated properties will remain pest-free for any specific duration. Our obligation is to apply appropriate treatment methods using industry-standard techniques and EPA-registered products. Texas Pest Control expressly disclaims all warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose. Re-treatment services, when provided, are limited to the specific pest species covered under the original service agreement and do not extend to new or different pest problems.
User Responsibilities
As a customer of Texas Pest Control, you agree to provide accurate and complete information regarding your property, existing pest conditions, prior treatments, and any health concerns of occupants including allergies, respiratory conditions, or chemical sensitivities. You must secure or remove pets, pet food, water dishes, children's toys, and food preparation items prior to scheduled treatments as instructed by our technicians. You are responsible for maintaining proper sanitation, eliminating standing water, sealing food storage containers, and addressing structural conditions that contribute to pest activity, including gaps, cracks, and moisture issues. Failure to follow these responsibilities may significantly reduce treatment effectiveness. You must notify Texas Pest Control of any adverse reactions, property damage, or unsatisfactory results within seventy-two hours of service completion. Unauthorized re-entry into treated areas before specified re-entry intervals may pose health risks for which you assume full responsibility. You may not solicit our technicians for services outside official company channels or engage them as independent contractors.
Limitation of Liability
To the maximum extent permitted by applicable law, Texas Pest Control and its officers, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or relating to our services, including but not limited to loss of profits, property damage beyond the scope of services performed, personal injury except where caused by our gross negligence or willful misconduct, allergic reactions or health effects in sensitive individuals, damage to landscaping or vegetation, or harm to pets resulting from failure to follow pre-treatment instructions. Our total cumulative liability for any claim arising from services rendered shall not exceed the total amount actually paid by you for the specific service giving rise to the claim during the twelve-month period preceding the event. This limitation applies regardless of the legal theory asserted, whether contract, tort, strict liability, or otherwise. You acknowledge that pest control services inherently involve certain risks and that pricing reflects this allocation of liability.
Intellectual Property
All content on the Texas Pest Control website, including text, graphics, logos, service marks, trade names, photographs, videos, technical documentation, treatment protocols, and software, is the exclusive property of Texas Pest Control or its licensors and is protected by United States copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any materials without our prior written consent. Customer testimonials or reviews submitted to Texas Pest Control may be used for marketing purposes without additional compensation. Any suggestions, ideas, or feedback you provide regarding our services may be implemented without obligation to you. The Texas Pest Control name, logo, and associated branding elements are registered or unregistered trademarks and may not be used in connection with any product or service that is not ours, in any manner likely to cause confusion among consumers, or in any manner that disparages or discredits Texas Pest Control.
Governing Law
These Terms of Service and any dispute arising from or relating to services provided by Texas Pest Control shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal action, proceeding, or dispute resolution shall be brought exclusively in the state or federal courts located in the county where the services were primarily performed, or if services were performed in multiple counties, in Bexar County, Texas. You consent to the personal jurisdiction and venue of these courts and waive any objection to such jurisdiction or venue on the basis of forum non conveniens or any other grounds. The parties agree that the United Nations Convention on Contracts for the International Sale of Goods shall not apply to these terms. If any provision of these terms is held invalid or unenforceable under Texas law, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.
Changes to Terms
Texas Pest Control reserves the right to modify, amend, or update these Terms of Service at any time without prior individual notice. Changes become effective immediately upon posting to our website or, for active service agreements, thirty days after written notification to the address or email on file. Your continued use of our services after changes take effect constitutes acceptance of the revised terms. If you do not agree to modified terms, you must notify us in writing and discontinue service before the effective date of changes. Changes will not apply retroactively to services already rendered. We encourage you to review these terms periodically. The date of last update will be revised accordingly at the top of this document. No oral modifications or waivers of these terms by any Texas Pest Control representative shall be binding. Only written amendments signed by an authorized officer of Texas Pest Control may alter these terms.
